Terms of Service

This is a plain-language summary of the rules for using CalcAI devices, software, and the website. It’s not legal advice. If you don’t agree, please don’t use or buy CalcAI products.

1) What we sell; no affiliation

  • We refurbish/modify calculators (e.g., add ESP32, camera, and firmware) and provide software/services to connect them to cloud AI features.
  • We are not affiliated with Texas Instruments, OpenAI, College Board, or any testing authority. Trademarks belong to their owners.
  • For learning/productivity only. Do not use on proctored exams unless the rules explicitly allow it.

2) Your responsibilities

  • Follow school/testing rules and the law. No cheating or tampering with proctoring/IT controls.
  • Provide reliable Wi‑Fi/internet. Third‑party firewalls/school networks may block features.
  • Use good judgment. AI output can be wrong or unsafe; verify important results.

3) Acceptable use

Do not use CalcAI to break laws, infringe rights, harass people, generate illegal content, bypass technical protections, or perform medical/legal/financial decisions without qualified human review. We may throttle or refuse service for abuse.

4) Third‑party services (OpenAI, Twilio, Stripe)

  • AI providers. When you use cloud features, your prompts, images, and outputs go to the provider (e.g., OpenAI) under their terms/privacy. Don’t submit secrets you don’t want processed in the cloud.
  • SMS. If you opt in, restock texts are sent via Twilio. Reply STOP to unsubscribe; HELP for help.
  • Payments. All payments are processed by Stripe. We do not store full card numbers or CVCs.

5) Privacy (short summary)

  • We may see and store your prompts, images, and AI responses for troubleshooting, quality, and to power features. We keep the latest image per device. See our Privacy Policy for details.
  • We do not collect Wi‑Fi SSID/passwords or your account passwords.
  • We log consent for SMS (phone number, consent IP/timestamp, status).

6) Software and updates

  • We may publish or deliver firmware/software updates, including security fixes. Updates can change or remove features.
  • Updates may be initiated by you from the calculator, or served remotely so your device can fetch them. We may require certain updates for safety or compliance.
  • Installing unapproved firmware, opening the device, or altering wiring may void the limited warranty.

7) Orders, shipping, returns, Stripe payments

  • Prices can change until checkout. We may cancel suspected-fraud orders with a prompt refund.
  • Taxes/duties are your responsibility. Risk of loss passes to you when we give the package to the carrier.
  • Unused stock units: limited return window (e.g., 14 days) may apply; shipping is non‑refundable. Custom/send‑in work is generally final sale except for defects we caused.
  • Payments run through Stripe. Refunds (if any) go back to the original method per Stripe timelines.

8) Limited warranty (workmanship)

We provide a 14‑day workmanship/DOA warranty from delivery. We will repair or replace (at our option) units that fail due to our workmanship. Damage from misuse, liquid, accidents, unsupported power sources, or unapproved modifications is not covered. Contact us before attempting any repair or firmware change; unapproved changes void the warranty.

9) Trademarks & no affiliation (Texas Instruments)

CalcAI is not affiliated with, sponsored by, or endorsed by Texas Instruments. References to TI‑84 and related marks are nominative fair use to describe compatibility only. Do not present our products as official TI products.

10) Disclaimers & liability limits

  • Except for the limited warranty above, products/services are provided “as is” and “as available.”
  • We do not guarantee compatibility with every network, API, or exam rule.
  • To the maximum extent allowed by law, we are not liable for indirect, incidental, or consequential damages; our total liability will not exceed what you paid for the item/service at issue.

11) Disputes; governing law

We’ll try informal resolution first (open a ticket on our Discord linked at calcai.cc). These Terms are governed by New Jersey law; courts in New Jersey have exclusive jurisdiction where permitted.

12) Changes; contact

  • We may update these Terms at any time. Changes apply to future orders/use. We will post the new effective date when we update.
